Terms of Service

My DNA Fragrance provides website features to you subject to the following conditions. If you visit or shop at www.mydnafragrance.com/perfume you accept these conditions. We reserve the right to change these terms and conditions at any time. Any change will be effective immediately and binding upon all visitors to the site. Each time you access this website, you agree to be bound by the Terms then in effect. In addition, when you use any current or future My DNA Fragrance  service or business (e.g., Your Profile, Purchases, Promotions, or Products) you also will be subject to the guidelines, terms and agreements ("Terms") applicable to such service or business. If these conditions are inconsistent with such Terms, the Terms will control.

 

My DNA Fragrance is uniquely created based on your DNA. No two fragrances smell alike. This requires that you provide us with a DNA sample. A DNA swab kit will be mailed to you for an easy at home oral swab collection. This procedure is painless and there is no blood collection. You simply take a special sized Q-tip swab and rub it on the inside of your check. The sample is then mailed back to our lab in the envelope that will be included with your kit. Once received by our lab, the sample will be processed to produce your unique profile and the sample will be destroyed in accordance with federal regulations. Samples are never sold for research and no information will ever be submitted to any bio-database.

Total Purchase Price:

Total purchase price for 1^st time customers is $139.99 for perfume and $119.99 for cologne. This price includes the one time DNA lab process, your “My DNA Fragrance” formulation, your choice of 2 ounces of your choice of perfume or cologne, a DNA home collection kit, and your DNA profile. You may upgrade to 4 oz fragrance size or hand blown glass bottles.  See prices in our shopping cart.

Refills:

Regular refills can be purchased separately at any time after your fragrance formulation is created and on file. Regular refill sizes include 2 ounces of perfume or cologne.  Or you may upgrade to 4 oz.  See prices in our shopping cart.

Worldwide Shipping & Turnaround Time:

All fragrance can be shipped worldwide.

My DNA Fragrance will ship the DNA Swab Kit worldwide using United States Postal Service 1st Class Mail.  Fragrance will be shipped after it is formulated using your pre-paid shipping fees once it is completed. 

 

Shipping - DNA Swab Kits

DNA Swab Kits are shipped worldwide using United States Postal Service 1st Class shipping, which is included free with your order. You may elect to expedite your DNA sample process and reduce the shipping days by building your own DNA Swab Analysis Kit using the instructions on our site and send the sample directly to our lab with the provided consent form.

Fragrance This shipping method does not include tracking or insurance. Times vary depending on the shipping location. You may elect alternative shipping methods and this will be added to your order at check out.

Exclusive Fragrance Shipping and Turnaround Time:

Our #1 priority is the security of your genetic information, absolute accuracy of the results and the production of a quality fragrance created exclusively for you. Our normal processing time for fragrance is 10-15 business days* after receipt and processing of your specimen by our lab. Your 'My DNA Fragrance' will be shipped to you by 1st class mail unless you specify an alternative method of shipment. Note: that mailing/shipping times may cause delays in receipt of your fragrance and we have no control over shipping dates once the package has been shipped.

Once we send you the swab collection kit we are dependent upon your turnaround time in sending it back to us to begin the fragrance formulation process. Please be patient and allow time for the full process taking into consideration that this is a customized product created exclusively for you. Fragrances are not mass produced by a machine.

Additional delays may included Non-compliant samples:

As with any biological testing, some exceptions may occur. The typical reason for extended testing is poor sample quality.

• Poor sample quality: If the swab submitted to the laboratory has low amounts of DNA due to improper sample collection or poor mouth conditions (e.g. excessive drinking, chewing gum, dry mouth, heavy smoking, etc.), the turnaround time may be increased because of the DNA analysis processing of your specimen. A recollection may be required. In the event of this exception we will supply an additional swab kit to you for recollection.

PLEASE NOTE: We do not guarantee a 10-15 business day turnaround time from the date of payment to the receipt of your fragrance. The 10-15 business day period is our best estimate of how long it will take to create your fragrance once the laboratory has completed your DNA profile. Additionally, the  10-15 business day turnaround time may be delayed if an exception is encountered and we must recollect your sample or the processing time becomes more extensive to produce the DNA results.

My DNA Fragrance will not sacrifice the quality of the results in order to speed up the turnaround time under any circumstances. If additional processing is required, we will notify you promptly. Again: note that this is a customized product formulated exclusively for you.

Extra DNA Swab Kits:

In most cases we will provide you with a replacement swab kit. However, My DNA Fragrance reserves the right to charge an additional $15 (plus shipping) for a replacement kit in the event that you lose or damage your kit.

Non-Compliant Samples:

Discovered Prior to Testing:

If we discover prior to testing that your samples are non-compliant (e.g. swabs are placed in a plastic bag, moldy swabs, insufficient number of swabs), we will attempt to notify you by Email, and ask you whether you would like us to proceed with the non-compliant sample or whether you would like to recollect your sample.

•  If you choose to proceed with the non-compliant sample, there is no guarantee regarding the quality of the results or whether any results can be obtained. The results will be reported "as is".

•  If you choose to recollect the sample, the replacement kit is $25 (plus shipping), and will have to repeat the sample collection.

If we do not have an email on file for you, or if we do not receive a response from you within 2 days after the notification email is sent, we will proceed with the non-compliant sample under the terms specified above.

Change of Address or Incorrect Address:

Please promptly report any changes in your address and/or email information so that we can stay in contact with you and assure delivery or your fragrance.

Quality Guarantee

We warrant our products to be superior quality; fragrances are designed exclusively for you using your DNA as the blueprint for your fragrance formulation which is totally unique to each customer.

My DNA Fragrance will do everything possible to supply the customer with an exotic fragrance but has no control over the actual fragrance mixture as each formulation is dependent upon the DNA blueprint.

 

Return Policy

My DNA Fragrance is made exclusively for each customer. it is a customized process.  Fragrances are not mass produced. 

Because our fragrance is an exclusive special order item we have a very strict return policy as  the process involves a  laboratory analysis of a DNA sample, in which the results are sent directly to you by email upon completion.  The laboratory process and the customization of each formulation by hand is extremely costly.

Because we have many customers ordering at once we can lower the cost of customization for each customer.  However, due to the nature of our process we do accept returns on any fragrance only, the DNA laboratory process is non-refundable as you have already received the results of this test when you receive your fragrance.  A careful check on the internet for the average price of  for a DNA test will provide you with some clarification on the cost associated with producing the DNA analysis alone.

If for some reason you have an issue with your fragrance we will attempt to resolve it through a remix.  In this case you will need to send the unused fragrance back to us with our form, which must include an approved RMA# from our claims department,  stating the problem and your signature within 5 days of receipt of your fragrance.  You are required to handle all return shipping fees and must notify us with the tracking number.

Payment Methods

This website accepts the following credit cards or debit cards bearing the logo: Visa, MasterCard, American Express through PayPal. If a credit card company is being used for a purchase, we may obtain a pre-approval from the credit card company for an amount up to the amount of the order. Billing to your credit card occurs at the time of purchase or shortly thereafter.

Please Note:

• Debit cards and check cards have daily spending limits that may prevent the processing of your order.
• If a purchase has been declined online due to credit card issues, please ensure all data is correct and resubmit.  If the transaction is not accepted online, you will be unable to use that card for your purchase and should use another credit card.

Billing

You will have one order that authorizes and bills as a single purchase.

Prices

This website endeavors to offer you competitive prices on current selections.  We reserve the right to change prices for products offered on our site at any time, and do not provide price protection or refunds in the event of a price drop or promotional offering.

We are not responsible for typographic errors made during your submission. Please verify your information carefully before submitting to ensure delivery of your product.

NOTE: Because My DNA Fragrance has a policy of continuous product improvement, we reserve the right to change design, packaging and specifications without notice.

We reserve the right to change content, product pricing, terms, specifications, shipping prices, shipping carriers, warranties and other information without notice. In addition, we may revise these terms of use at any time by updating the website. Online sales are intended for, and limited to, personal use and domestic sales only. We reserve the right to limit the number of Products sold, including the right to prohibit sales to re-sellers. Prices do not include shipping, tax or insurance.

 

Special offers may expire without notice, limited-time specials may expire or end without notice. Promotional offers may end when stock is depleted.

If you are purchasing Products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country.

 

Damages:   Except as specifically stated on this site, neither MY DNA nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties. My DNA's liability to you shall in no event exceed the amount of the products in dispute.

 

All sales on this website are governed by California law, without giving effect to its conflict of law provisions.
